Polymarket US does not accept Massachusetts residents. Kalshi does, sports included, but only because a state-court injunction against its sports contracts is on hold while the Supreme Judicial Court decides Kalshi's appeal. That court heard argument on May 4, 2026 and had not ruled by mid-October. If it rules for the state, Kalshi's sports markets in Massachusetts could close quickly. Robinhood lists no Massachusetts restriction. DraftKings Predictions and FanDuel Predicts offer non-sports contracts only.

Kalshi in Massachusetts

The Massachusetts Attorney General sued Kalshi in Suffolk County Superior Court in 2025, arguing its sports contracts are sports wagering that needs a state licence. On January 20, 2026 the court agreed at the preliminary stage and enjoined Kalshi from offering sports contracts to Massachusetts users (Covers, Jan 20, 2026).

The Appeals Court then stayed that order, without taking a view on the merits, and the case went to the Supreme Judicial Court. Seven justices heard argument on May 4. Several pressed Kalshi's lawyer hard on federal preemption; one told him he was "swimming upstream" (InGame, May 4, 2026). Kalshi has to win two points: that its contracts are swaps, and that federal law displaces state gambling law. The state wins if it prevails on either. In June 2026 the state amended its complaint to add claims about Kalshi marketing to under-21 students on campuses.

As of October 15, 2026, the injunction remained stayed and no SJC decision had been reported (OddsShopper). Politics, economics, weather and culture contracts are not part of the case.

Polymarket US in Massachusetts

Polymarket's US app runs on QCX, the CFTC-licensed exchange it bought in July 2025, under an amended CFTC order announced on November 25, 2025 (Covers). It does not onboard Massachusetts residents. The block is Polymarket's own choice; we found no Massachusetts order naming Polymarket. The sign-up screen is the final check.

Using a VPN to reach Polymarket's US or international product breaks its terms and can get the account frozen.

Robinhood in Massachusetts

Robinhood's support page restricts sports contracts for Maryland and Nevada residents and stops new sports positions for Michigan residents from September 9, 2026. Massachusetts is not listed, but Robinhood says other state limits may apply and the app shows the current list (Robinhood). Robinhood routes contracts to KalshiEX, ForecastEx, Rothera or Crypto.com's North American Derivatives Exchange. If the SJC rules against Kalshi, Robinhood's Kalshi-listed sports contracts may also be affected.

FanDuel Predicts and DraftKings Predictions

Both companies run licensed sportsbooks in Massachusetts, so neither lists sports contracts here. DraftKings Predictions offers non-sports markets; FanDuel Predicts lists non-sports contracts in all 50 states and DC. For sports, the regulated route is a sportsbook licensed by the Massachusetts Gaming Commission.

Novig, OG and PredictIt

Novig has been a CFTC-designated contract market since June 16, 2026 and requires users to be 21. Its welcome offer lists Massachusetts among eligible jurisdictions, which suggests the exchange is open here, but confirm in the app (Action Network).

OG (Crypto.com) is reported to restrict sports contracts in Massachusetts; non-sports markets may still show.

PredictIt runs political markets with a $3,500 per-market limit and no cap on traders, after a July 2025 CFTC letter (CFTC Letter 25-20).

Taxes in Massachusetts

Massachusetts taxes most income at 5%, with a 4% surtax on income above about $1 million (the threshold is indexed each year) (Massachusetts DOR). Trading profits are taxable at both state and federal level. See the event-contract tax guide.

How to check your own access

  1. Start the sign-up flow. Each platform asks your state and blocks you if it must.
  2. Open a sports market on Kalshi. If the SJC rules and the injunction takes effect, the market will show as unavailable.
  3. Use your real address and no VPN.
