New Jersey is where Kalshi has won. On April 6, 2026 the Third Circuit ruled 2-1 that federal commodities law shields Kalshi's sports contracts from New Jersey's gambling regulators, and an injunction keeps the state from enforcing against it. New Jersey has asked the US Supreme Court to take the case. Robinhood lists no New Jersey restriction. Sources disagree on Polymarket US: most lists of blocked states leave New Jersey off, one includes it.

An earlier version of this page said Polymarket was geo-blocked in New Jersey. We could not confirm that, so the page now reports the conflict instead.

Kalshi in New Jersey

The New Jersey Division of Gaming Enforcement sent Kalshi a cease-and-desist letter over its sports contracts in 2025. Kalshi sued in federal court, won a preliminary injunction, and the state appealed. On April 6, 2026 the Third Circuit affirmed 2-1. The majority held that the Commodity Exchange Act likely preempts New Jersey's sports-wagering law as applied to contracts listed on a CFTC-designated exchange.

That ruling now sits against two that went the other way: the Ninth Circuit for Nevada (August 28) and the Sixth Circuit for Ohio and Tennessee (September 25). A split between appeals courts is the usual reason the Supreme Court takes a case. New Jersey filed its petition on September 2 (No. 26-299), and Kalshi's response is due November 9. The district-court case continues in the meantime (OddsShopper, October 15, 2026).

For New Jersey residents, that means Kalshi's full menu, including sports, is open for now. A Supreme Court decision against Kalshi would end that, though a ruling would take months.

Robinhood in New Jersey

Robinhood's current support page restricts sports contracts only for Maryland, Nevada and Michigan residents (Robinhood, October 2026). Contracts route to KalshiEX, ForecastEx, Rothera or Crypto.com's North American Derivatives Exchange. The app shows what your account can trade.

FanDuel Predicts and DraftKings Predictions

Both companies run licensed online sportsbooks in New Jersey, so neither offers sports contracts here. For sports wagering, the state-licensed sportsbooks regulated by the Division of Gaming Enforcement are the regulated route.

Novig, OG and PredictIt

Novig has been a CFTC-designated contract market since June 16, 2026 and requires users to be 21. New Jersey is not on its welcome-offer state list, so check the app (Action Network).

OG, Crypto.com's app, launched February 3, 2026 on Crypto.com | Derivatives North America, a CFTC-registered exchange. One review says New Jersey residents gained access to its sports contracts after the Third Circuit ruling. Confirm in the app.

PredictIt runs political markets with a $3,500 per-market limit after a July 2025 CFTC letter removed the old $850 cap and the 5,000-trader limit (CFTC Letter 25-20).
